Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Reputable Click websites, dashboard, documentation, and APIs (collectively, the "Services"). The Services are operated by Kaytos, LLC ("Kaytos", "Reputable Click", "we", "us", or "our").
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Data Processing: When you use the Services to process information about your end users, we act as a data processor (or service provider) on your behalf. Please review our Data Processing Agreement and Privacy Policy for details on how we handle data.
1. Who You Are
You may use the Services as an individual or on behalf of a company or other organization. If you use the Services on behalf of an entity, you represent and warrant that you have authority to bind that entity, and "you" refers to that entity.
2. The Services
Reputable Click helps customers protect their websites and applications from automated and fraudulent traffic. The Services may include:
- Verification redirects: End users may be redirected to a Reputable Click verification page and back to your site;
- Scoring and classification endpoints: APIs that return reputation data, risk signals, and classification;
- A customer dashboard to manage configuration, keys, rules, and settings;
- Instrumentation tools such as client snippets and server-side event ingestion;
- Third-party verification challenges (such as hCaptcha or reCAPTCHA) presented during verification.
Scores and classifications are probabilistic signals based on the information available at the time. They may contain errors and may change over time as the Services evolve. You are responsible for how you use the outputs of the Services.
3. Eligibility and Minimum Age
The Services are not directed to children. You may not use the Services if you are under 13 years old (or under 16 in the European Economic Area, Switzerland, or the United Kingdom). You may only use the Services if you can legally form a binding contract with us.
4. Accounts and Security
If you create an account, you must provide accurate information and keep it up to date. You are responsible for all activity under your account and for keeping your credentials and API keys secure. Notify us promptly if you suspect unauthorized access or misuse.
We may suspend or disable accounts or keys if we believe they are compromised or used in a way that creates risk to the Services or others.
5. Plans, Fees, and Taxes
Some parts of the Services may be offered for free, in beta, as a trial, or for a fee. If you purchase a paid plan:
- You authorize us (and our payment processors, if applicable) to charge applicable fees and taxes;
- Fees are non-refundable except where required by law or expressly stated at purchase;
- We may change prices or plan features with advance notice where required.
6. Acceptable Use
You agree not to misuse the Services. For example, you must not:
- Use the Services in violation of applicable law (including privacy, advertising, and anti-fraud laws);
- Interfere with or disrupt the Services, including by probing, scanning, load testing without permission, or attempting to bypass rate limits;
- Reverse engineer, decompile, or attempt to discover source code or non-public APIs, except to the extent prohibited by law;
- Access or use the Services to build a competing product or to benchmark publicly without our prior written consent;
- Transmit malware or use the Services to facilitate phishing, credential stuffing, or other abusive activity;
- Submit to us (or configure your systems to submit to us) sensitive personal information unless we have agreed in writing (for example: government IDs, payment card data, passwords, precise geolocation such as GPS coordinates, health information, biometric templates, or other highly sensitive data). Note: The Services infer approximate location (country, region, city) from IP addresses, which is not considered precise geolocation.
We may monitor and enforce these Terms to protect the Services and our users.
7. Customer Responsibilities for End-User Data
You are the data controller for your end users. When you use our Services (including verification redirects), you are responsible for:
- Providing appropriate notices to your end users that they may be redirected to a third-party verification service and that data will be processed for security and fraud prevention purposes;
- Obtaining any required consents (including for cookies, local storage, and any tracking or fingerprinting where required by applicable law);
- Ensuring you have a lawful basis to share End-User Data with us and to act on our outputs;
- Configuring your integration to avoid sending unnecessary personal information (for example, avoid putting emails, names, or order IDs into URLs or event metadata that you send to us).
- Addressing automated decision-making obligations where applicable. The Services may automatically classify, score, challenge, or block traffic. Where applicable law (such as GDPR Article 22) gives individuals rights related to automated decision-making, you are responsible for providing appropriate disclosures and safeguards in your own privacy notices and processes.
If you are subject to GDPR or similar laws and we process End-User Data on your behalf, you should enter into a Data Processing Agreement with us.
8. Customer Content and Configuration
You (or your organization) own your configuration, rules, and data you submit to the Services ("Customer Content"). You grant us a worldwide, non-exclusive license to host, run, copy, transmit, and process Customer Content solely to provide, secure, and improve the Services.
You are responsible for ensuring Customer Content complies with law and does not infringe others' rights.
9. Third-Party Services
The Services interoperate with third-party services including:
- Verification providers: hCaptcha (Terms, Privacy) and Google reCAPTCHA (Terms, Privacy) may be used during verification challenges;
- Identity providers: GitHub, Google, and other OAuth providers if you choose to sign in using those services;
- Infrastructure providers: Cloudflare, Hetzner, and other hosting/CDN providers.
Your use of those third-party services is governed by their terms and policies, and we are not responsible for them.
10. Confidentiality
You agree to keep confidential any non-public information about the Services that we provide to you, including but not limited to:
- Bot detection methods, algorithms, and scoring logic;
- Non-public API documentation or features;
- Security vulnerabilities or incidents.
You may not publicly disclose or share such confidential information without our prior written consent.
11. Feedback
If you provide feedback, suggestions, or ideas, you grant us a perpetual, irrevocable, worldwide right to use them without restriction or compensation.
12. Availability, Changes, and Beta Features
We may change, suspend, or discontinue any part of the Services at any time. Some features may be labeled alpha/beta/preview and are provided "as is" and may be modified or removed at any time.
13. Suspension and Termination
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, if required to comply with law, or to protect the Services, our users, or third parties.
Upon termination, your right to use the Services stops. We will delete or return End-User Data in accordance with our Data Processing Agreement. Some provisions (including intellectual property, confidentiality, disclaimers, limitation of liability, and indemnity) survive termination.
14. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT SCORES OR CLASSIFICATIONS WILL BE ACCURATE.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAYTOS, LLC AND ITS AFFILIATES, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) $100 USD OR (B) THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
16. Indemnification
You agree to indemnify and hold harmless Kaytos, LLC and its affiliates, officers, directors, employees, and agents from and against claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Services, your Customer Content, your end users' claims, or your violation of these Terms or applicable law.
17. Governing Law and Venue
Except to the extent applicable law provides otherwise, these Terms and any dispute arising out of or relating to the Services will be governed by the laws of the State of California, U.S.A., excluding conflict-of-law rules. The proper venue for disputes will be the state and federal courts located in Los Angeles County, California, U.S.A.
18. US Economic Sanctions / Export
You represent that you are not located in a country subject to comprehensive U.S. sanctions, and you are not on a U.S. restricted parties list. You agree not to use the Services in a way that would cause us to violate U.S. export controls or sanctions.
19. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and may provide additional notice. Your continued use of the Services after changes become effective means you accept the updated Terms.
